Terms of sale.

These terms govern the sale of paid subscriptions offered by Blokby, in particular on math.blokby.fr. They are accepted by the customer before any payment.

Subject matter and scope

These terms of sale (the "Terms") apply to any subscription to a paid plan offered on math.blokby.fr. They supplement the terms of use, accessible at https://blokby.fr/fr/cgu.

By ticking the acceptance box at the time of ordering, the customer acknowledges having read these Terms and accepts them without reservation.

Products and services

The "All-Access" subscription gives access to all mini-applications on math.blokby.fr, present and future, for the duration of the subscription. The essential characteristics are presented on the offer page before ordering.

A free plan, without payment, may be offered separately; it is not governed by these Terms.

Pricing

Prices are shown in euros, inclusive of all taxes (VAT not applicable, Article 293 B of the French General Tax Code). The subscription is offered on a monthly or annual basis, at the customer's choice.

The applicable price is the one in force at the time of ordering. Blokby reserves the right to change its prices; any change affecting a current subscription is communicated to the customer in advance and takes effect at the next renewal.

Order

Placing an order requires creating an account, selecting a plan, accepting these Terms, and then making payment. The subscription is confirmed after payment has been validated.

Payment

Payment is processed by our provider Stripe, by credit or debit card. Blokby does not retain your card details, which are managed securely by Stripe.

The subscription gives rise to an automatic recurring payment at each renewal (monthly or annual) until it is cancelled.

Duration, renewal, and cancellation

The subscription is taken out with no minimum commitment and is tacitly renewed at each period, for an identical period, unless cancelled.

The customer may cancel at any time from their personal space. Cancellation takes effect at the end of the current period: access is maintained until that date, with no further charge thereafter.

Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, the consumer is in principle entitled to a fourteen (14) day period to withdraw from a distance purchase.

However, the subscription gives immediate access to digital content. By subscribing, the customer expressly requests immediate performance of the service and acknowledges waiving their right of withdrawal from the start of performance, in accordance with Article L221-28, 13° of the French Consumer Code. The right of withdrawal can therefore no longer be exercised.

Refunds

Outside the right of withdrawal described above, subscription periods already started do not give rise to a refund, as cancellation takes effect prospectively. Legal guarantees and refund cases provided for by law remain applicable.

Consumer mediation

In accordance with Article L612-1 of the French Consumer Code, the consumer has the right to have free recourse to a consumer mediator for the amicable resolution of a dispute with the trader, after a prior written complaint has gone unanswered satisfactorily.

The details of the competent consumer mediator are provided to the consumer on request at contact@blokby.fr and stated herein as soon as the trader joins a mediation scheme. The consumer may also have recourse to the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Warranties and liability

The consumer benefits from applicable statutory guarantees. Blokby's liability cannot be engaged in the event of force majeure or non-performance attributable to the customer or a third party. To the extent permitted by law, Blokby's liability is limited to the amount of the subscription concerned.

The processing of data related to your subscription and payment is described in the privacy policy, accessible at https://blokby.fr/fr/privacy.

Governing law and disputes

These Terms are governed by French law. In the event of a dispute, the customer first contacts customer support to seek an amicable resolution, then, if necessary, the consumer mediator. Failing agreement, the competent courts are determined in accordance with consumer-protection rules.
